Terms of Service

These Terms of Service ("Terms") govern your access to and use of Mentapps Cloud ("the Platform"), operated by Mentapps ("we," "us," or "our"). By creating an account or using any part of the Platform, you agree to these Terms.

1. The Platform

Mentapps Cloud is a multi-service digital platform for businesses. Current services include website publishing for real estate agencies. Additional services may be made available over time. Each service may be subject to additional terms presented at the time of activation.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in your jurisdiction to use the Platform. By registering, you represent that you meet these requirements.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and current information during registration.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at legal@mentapps.cloud if you suspect unauthorised access.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Upload or publish content that infringes intellectual property rights or is defamatory, fraudulent, or harmful.
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
• Interfere with or disrupt the Platform or other users' access to it.
• Use the Platform to send unsolicited commercial communications.

5. Content You Publish

You retain ownership of all content you upload or publish through the Platform. By uploading content, you grant Mentapps a limited, non-exclusive licence to store, display, and deliver that content solely for the purpose of operating the Platform on your behalf. We do not claim ownership of your content.

You are solely responsible for ensuring your published content complies with all applicable laws and does not violate any third-party rights.

6. Subscriptions and Payment

Certain features of the Platform require a paid subscription. Subscription fees, billing cycles, and available plans are displayed at the time of purchase. By subscribing, you authorise us to charge your payment method on the applicable billing cycle. Subscriptions renew automatically unless cancelled before the renewal date.

All fees are stated in the currency displayed at checkout. We may update pricing with reasonable advance notice.

7. Cancellation

You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. Access to subscription features continues until that date.

8. Custom Domains

If you purchase or connect a custom domain through the Platform, you are responsible for ensuring you have the right to use that domain name. Domain registration is subject to the policies of the applicable domain registry. Domain fees may be non-refundable once registration is completed.

9. Service Availability

We aim to keep the Platform available and reliable. However, we do not guarantee uninterrupted access. We may carry out maintenance, updates, or emergency repairs that temporarily affect availability. We will use reasonable efforts to notify you of planned downtime.

10. Intellectual Property

The Mentapps name, logo, platform design, and all underlying technology are the property of Mentapps and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you.

11. Limitation of Liability

To the maximum extent permitted by law, Mentapps and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these Terms shall not exceed the total fees you paid to us in the three months preceding the claim.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by applicable law.

13. Termination

We may suspend or terminate your account if you materially breach these Terms and fail to remedy the breach within a reasonable period after notice. You may close your account at any time by contacting us. Upon termination, your right to access the Platform ends.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and, where changes are material, notify you by email or through the Platform. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction in Nigeria, unless otherwise required by applicable consumer protection law in your jurisdiction.
